TERMS AND CONDITIONS OF MIO CLUBS
COMPANY IDENTIFICATION
Mio Clubs is a wellness space operated by Mio Wellness Group SL, with its registered address at Cossiers, 14, 07010, Palma de Mallorca, Spain, and VAT number B19998475. PURPOSE OF THE AGREEMENT
These Terms and Conditions govern access to and use of the services offered by Mio Clubs, including the use of facilities, participation in activities, and the hiring of complementary services.
TERMS OF USE
Users must comply with the established rules of conduct, respect other members, and use the facilities and equipment properly. Mio Clubs reserves the right of admission in all cases and may suspend access to any users who fail to comply with the rules. Users are responsible for any damage caused to the facilities or other users as a result of inappropriate use and must bear the costs of repair, compensation, or damages resulting from their actions.
REGISTRATION AND ACCESS TO SERVICES
To access certain services, users must register and provide truthful information about themselves. It is the user's responsibility to maintain the confidentiality of their access credentials.
PAYMENT AND BILLING POLICY
Payments will be made through the methods enabled by Mio Clubs. Fees may be changed at any time without prior direct notice to each user. Mio Clubs is not obligated to provide any compensation for such fee changes. All prices and service fees include applicable taxes under Spanish law. Mio Clubs reserves the right to apply promotions and discounts.
CANCELLATIONS AND REFUNDS
Cancellation and refund conditions will vary depending on the service contracted. Once a service is contracted, Mio Clubs will not issue refunds or compensation for cancellations or changes. Membership cancellations must be communicated at least 15 days in advance by the user to the company via email at hola@mioclubs.com. After this 15-day notice period, the membership cannot be canceled on shorter notice, and Mio Clubs will charge the corresponding monthly fee, regardless of whether the user uses the services.
PROPER USE OF FACILITIES
Users must comply with hygiene and safety standards. The consumption of prohibited substances is not allowed within the facilities.
RULES OF COEXISTENCE AND BEHAVIOR
Users must behave respectfully toward staff and other users. Any behavior causing discomfort, harassment, or violence within the facilities is strictly prohibited. Eating and smoking are not allowed inside the premises. Users must dress appropriately to access the facilities; entry without proper clothing is not permitted. Any breach of these rules will result in suspension of membership and expulsion from the club, without the right to claims, refunds, or compensation.
MAINTENANCE AND SERVICE AVAILABILITY
Mio Clubs reserves the right to carry out maintenance work that may temporarily affect service availability. In case of extended closures, users will be notified in advance. Mio Clubs also reserves the right to modify the offer of activities and services provided, without the obligation to offer economic compensation or refunds.
LIMITATION OF LIABILITY
Mio Clubs is not responsible for personal items lost within the facilities. Users access and use the services at their own risk. Neither the user nor their successors, immediate environment, or anyone responsible for them shall have the right to claim damages or injuries arising from the use of the facilities or services provided.
ACCESS TO COMPLEMENTARY SERVICES
Some services may require an additional fee. Mio Clubs may offer promotions and discounts for such services. The user declares to be in good physical condition to participate in physical activity and acknowledges the risks it may entail.
TERMS FOR EXTERNAL SERVICES
Mio Clubs may work with external collaborators to provide certain services. In these cases, users agree to the terms established by such third parties.
DATA PROTECTION POLICY
Users' personal data will be processed in accordance with current data protection regulations. Mio Clubs guarantees the confidentiality and security of personal data in accordance with the General Data Protection Regulation (GDPR). Users have the right to access, rectify, and delete their personal data. For more details, please refer to our [Privacy Policy].
SAFETY AND RISK PREVENTION
Users must follow established safety rules within the facilities. Mio Clubs may require the signing of liability waivers for certain activities. Users are responsible for their own well-being and acknowledge they participate in activities at their own risk.
CHANGES TO SERVICES AND SCHEDULES
Mio Clubs may modify opening hours, activity schedules, and service access conditions without prior notice to users. All updates and schedule changes must be checked by the user in the club’s app.
LOCKER AND PRIVATE SPACE USE RULES
Lockers are for daily use and must be emptied after each session. Mio Clubs is not responsible for items left in lockers outside of service hours.
COMPLAINT PROCEDURE
Users may submit complaints via email to hola@mioclubs.com or through the complaints book available at the center.
PRIVATE EVENT SPACE BOOKING
Mio Clubs offers users the option to book the facilities for private events. The club reserves the right to temporarily close the entire club for private events without compensation to members. Such closures will be communicated via email and the club’s app.
DISCLAIMER FOR ACCIDENTS OR INJURIES
Mio Clubs is not liable for injuries, accidents, or damages that users may suffer within the facilities. Each user assumes responsibility for their own well-being and acknowledges that they participate in activities at their own risk, except in cases of gross negligence by Mio Clubs.
MEMBERSHIP SUSPENSION POLICY
Users may request a temporary suspension of their membership for justified reasons such as illness or extended travel. Requests must be made at least 15 days in advance and are subject to approval.
ACCESS FOR PEOPLE WITH REDUCED MOBILITY
Mio Clubs is committed to ensuring its facilities are accessible to people with reduced mobility. If additional assistance is needed, users are advised to notify in advance.
USE OF ELECTRONIC DEVICES
Electronic devices must be used respectfully within the facilities. Recording videos or taking photographs is prohibited without prior authorization from club management.
IMAGE RIGHTS IN EVENTS
Users participating in events organized by Mio Clubs agree that their image may be used in promotional material, unless they express their opposition in writing prior to the event.
DRESS CODE
To ensure comfort and hygiene for all users, appropriate sportswear must be worn within the facilities. Training barefoot is not allowed, except for specific activities where otherwise indicated.
USE OF PERSONAL CARE PRODUCTS
The use of personal hygiene products with strong fragrances is discouraged to avoid discomfort to other users.
MODIFICATION OF TERMS AND CONDITIONS
Mio Clubs may modify these terms and conditions at any time. Changes will be communicated to users via registered email or through a visible notice on our website.
APPLICABLE LAW AND JURISDICTION
These terms are governed by Spanish law. Any dispute shall be resolved before the courts of Palma de Mallorca. Parties may seek alternative dispute resolution methods such as mediation or arbitration before resorting to the courts of Palma de Mallorca.
